  • What is bankruptcy?

    For people who are unable to pay their unsecured debt, it is a federal law that allows them to escape that debt.

  • What debts are wiped out by a bankruptcy and what debts are not?

    There are three categories of debt.  


    One: debts that cannot be wiped out, like student loans, child support, most taxes, and debt incurred by fraud.  


    Two: creditors with collateral; if you want the collateral, you pay for it, or you can choose to turn it back, and the lender falls into category three.  


    Three: unsecured creditors; this includes collateral that was turned back, credit cards, medical bills, payday loans, internet loans, and basically everyone not in categories one and two. These debts are wiped out in a Chapter 7 Bankruptcy

  • How do I know if I qualify for a bankruptcy?

    Oddly, there is no requirement that you be bankrupt to file a bankruptcy!  If you have unsecured debt that you cannot afford to pay, you qualify.

  • What about medical bills? My neighbor says I cannot include them in a bankruptcy. Can I include them?

    Absolutely. You can include medical bills in bankruptcy.
